These Terms of Service (“Terms”) govern access to maplsoda.ca and purchases from Mapl Soda. The site and store are operated by Boissons Mapl Inc. (“Mapl,” “we,” “us,” or “our”). By using the site or submitting an order, you agree to the Terms that apply at that time.

Nothing in these Terms limits a mandatory consumer right, legal warranty, privacy right, cancellation right, or other remedy that cannot lawfully be excluded or waived.

1. Eligibility and Accounts

You must have legal capacity to enter into a contract or use the site with authorization from a parent, tutor, or legal representative. You are responsible for providing accurate, current information and for activity under your account. Keep account credentials confidential and notify us promptly of suspected unauthorized use.

We may suspend access to protect customers or the site, investigate suspected fraud or misuse, comply with law, or address a material breach of these Terms.

2. Products and Information

We make reasonable efforts to describe and display products accurately. Screen settings, packaging updates, natural ingredients, and production batches can create minor differences in colour or appearance. Product availability may change without notice before an order is accepted.

Always review the physical product label for the current ingredients, allergen information, nutrition facts, storage instructions, lot code, and best-before information before consuming the product. Website content is general information and is not medical, nutritional, or other professional advice. Do not consume a product if you are allergic or sensitive to an ingredient or if the package appears unsafe or compromised.

3. Orders and Contract Formation

Before submission, checkout gives you an opportunity to review, correct, accept, or refuse the proposed order. When checkout presents the essential terms and you submit the order using an authorized payment method, a contract is formed, subject to applicable law. The order confirmation is your copy of the transaction and should be retained.

We may use automated controls before or during checkout to reject an invalid payment, prohibited transaction, quantity above a disclosed limit, address we cannot serve, or suspected fraud. If checkout does not complete, no order is formed and any temporary payment authorization will be released or reversed.

Once a contract has been formed, Mapl will not cancel it merely because of a pricing error or inventory shortage where applicable consumer law prohibits that cancellation. Any correction, substitution, delay, or cancellation will be handled in accordance with applicable law and the customer's agreement where required.

Products sold through the retail site are intended for the purchaser, household, or gift recipient. Wholesale or resale purchases require a separate written agreement unless we expressly authorize them through the site.

4. Prices, Taxes, and Payment

Prices are shown in Canadian dollars unless stated otherwise. Applicable taxes and delivery charges are calculated and displayed before the order is submitted. Promotions, discounts, and free-shipping offers apply only when their eligibility conditions are satisfied and they appear in checkout.

You authorize us and our payment providers to charge the displayed amount using the selected payment method. You represent that you are authorized to use that method. Payment information is processed by Shopify and its payment providers under their applicable terms and privacy notices.

5. Subscriptions and Recurring Orders

When you start a subscription, the price, products, quantity, delivery frequency, benefits, renewal timing, and recurring charge are displayed before enrolment. You authorize recurring charges according to those disclosed terms until the subscription is changed or cancelled.

Subscription benefits and future prices may change. Where required, we will provide notice before a material change takes effect. A change applies prospectively and does not alter an order already processed. Instructions and deadlines for skipping, pausing, changing, or cancelling are provided in the subscription account interface and our Subscription Policy. Cancelling a subscription stops future eligible renewals but does not automatically cancel an order already processed.

6. Shipping, Delivery, Returns, and Refunds

Our Shipping and Delivery Policy forms part of these Terms and explains service areas, processing times, charges, estimates, local delivery, address errors, and delayed or missing orders.

Our separate Returns and Refunds Policy forms part of these Terms and explains final-sale food and beverage products, eligible product claims, evidence, returns, and available resolutions.

7. Promotions and Gift Offers

Unless an offer states otherwise, promotions are available for a limited time, have no cash value, cannot be combined, and may be limited by product, order, customer, location, or subscription status. We may correct or end a promotion prospectively. We may reject attempted abuse, duplication, manipulation, or unauthorized resale of a promotion, subject to applicable law.

8. Acceptable Use

You may not use the site to:

• violate law or another person's rights;
• submit false, fraudulent, abusive, or misleading information;
• introduce malicious code, bypass security, scrape at unreasonable volume, or interfere with the site;
• impersonate another person or use a payment method without authorization;
• copy, exploit, or resell site content except as permitted by law or written authorization; or
• harass our personnel or other users.

9. Intellectual Property

The site and its text, graphics, photographs, videos, product names, logos, packaging, designs, and other content are owned by or licensed to Mapl and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive right to access and use the site for lawful personal shopping and information. No trademark, copyright, or other right is transferred.

10. Reviews, Messages, and Other Submissions

If you voluntarily submit a review, photograph, idea, feedback, or other content for public use, you represent that you have the right to submit it and that it is not unlawful, misleading, infringing, or harmful. You grant Mapl a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, translate, publish, and display that submission for operating, improving, and promoting Mapl, subject to our Privacy Policy and any specific agreement with you. You retain ownership of your content.

We may remove public content that violates these Terms or law. Customer-service and claim materials are used as described in our Privacy Policy and are not made public merely because they were submitted to us.

11. Third-Party Services and Links

The site may rely on or link to third-party services, including Shopify, payment, subscription, shipping, analytics, social-media, or other providers. Their own terms and privacy notices may apply to their services. We are not responsible for independent third-party sites, but this does not remove any responsibility Mapl has under applicable law for the transaction with you.

12. Privacy

Our Privacy Policy explains how we handle personal information and forms part of these Terms where applicable. By using optional analytics, advertising, accounts, or marketing features, you may also be presented with specific privacy choices or consent requests.

13. Warranties and Liability

Québec and other applicable laws may provide legal warranties and remedies, including that goods must be fit for their ordinary purpose, durable for a reasonable time, and conform to their description. Those rights are not restricted by these Terms.

To the fullest extent permitted by law, Mapl is not liable for indirect or unforeseeable loss that is not caused by our breach or fault. We do not exclude or limit liability where doing so is prohibited, including liability arising from intentional or gross fault, bodily or moral injury, a mandatory legal warranty, or a mandatory consumer remedy.

Reasonable delays caused by events outside a party's control may extend performance to the extent permitted by law, but do not eliminate any cancellation, refund, delivery, or other right that applicable law gives the customer.

14. Governing Law and Disputes

These Terms are governed by the laws of Québec and the federal laws of Canada applicable there, without depriving a consumer of mandatory protections or jurisdictional rights available in the consumer's province or territory.

Before starting a formal proceeding, please contact us so we can attempt to resolve the issue. Nothing in these Terms requires mandatory arbitration or prevents a customer from using a court, regulator, consumer-protection authority, chargeback right, or other lawful process available to them.

15. Changes to the Site and Terms

We may update the site and these Terms prospectively. The version in effect when an order is submitted applies to that order unless a change is required by law or the parties validly agree otherwise. We will post a new “Last updated” date and provide additional notice where required for a material change.

16. General Terms

If part of these Terms is invalid or unenforceable, it will be interpreted or severed only to the minimum extent necessary, and the remainder continues to apply. A delay in enforcing a provision is not a waiver. These Terms and the policies incorporated above are the agreement governing retail use of the site, except for any additional terms clearly presented and accepted for a specific product or service.

17. Language

Les parties ont demandé que les présentes modalités et les documents qui s'y rattachent soient rédigés en français et en anglais. The parties have requested that these Terms and related documents be drawn up in French and English. The French and English versions are intended to have the same meaning. If a discrepancy cannot be reconciled, the version that preserves the customer's mandatory rights will apply.
